The Ministry of Women and Child Development informed the Rajya Sabha that it has provisions to make consequential amendments relating to age of marriage in The Indian Christian Marriage Act, 1872; The Parsi Marriage and Divorce Act, 1936; The Muslim Personal Law (Shariat) Application Act, 1937; The Special Marriage Act, 1954; The Hindu Marriage Act, 1955; and The Foreign Marriage Act, 1969.
The task group, according to the Ministry, looked into the relationship between motherhood and age of marriage as well as various other connected issues before the Bill was introduced in Parliament.
It had recommended raising the age of marriage for women to 21 years at parity with men after holding extensive consultations with all pertinent stakeholders to provide an effective impetus for greater gender equality in society and open the door for a girl to enrol in and complete education, professional training, and vocational courses.
The task force had also suggested that the government be given the option of two dates for the implementation of the amendment: two years from the date of notification of the amendment, or a staggered schedule raising the marriage age by one year at a time beginning one year after notification of the amendment.
The government claimed that after looking into all factors relating to child marriages, including the task force's recommendations, it has proposed putting the amendments into effect two years after notification to give people enough time to get ready for this historic change.
Males and females in India must be at least 21 years old before getting married. Men and women must be at least 21 and 18 years old, respectively, to get married under the Special Marriage Act of 1954. Under the Special Marriage Act, male and female partners who are 21 or older may get married.
