Can NRI File A Case Against Any Indian Company?

The Indian court may choose not to hear cases with a foreign element despite having jurisdiction in other circumstances, such as those involving contracts with predefined jurisdiction, arbitration, etc. Indian courts occasionally reject jurisdiction in a particular matter by invoking the doctrine of forum non conveniens.

Case Laws:

In the case of Ethiopian Airlines v. Ganesh Narain Saboo, the Hon'ble Supreme Court of India made this observation, concluding that the specific statutes of the Consumer Protection Act of 1986 and the Carriage by Air Act of 1972 would prevail over the general statute of the Code of Civil Procedure of 1908.


The Transport by Air Act of 1972 was passed with the intention of implementing the Warsaw Convention of 1929, to which Ethiopia is a party. On the basis of a reading of the Warsaw Treaty of 1929 and the Transport by Air Act of 1972, it is evident in practice that these limits apply to airlines of any country.


The Hon. The Supreme Court established with this justification that the Convention and Act have the following effects: The Central government has previously given its assent in compliance with Section 86 by passing the Transport by Air Act, 1972. The Foreign State of Ethiopia impliedly relinquished privilege by ratifying the Warsaw Pact of 1929.


So, the government has devised a proper NRI complaints mechanism. Any dissatisfied NRI may make a complaint using the previously described process with the Office of Protector of Emigrants or the state NRI cell (if his home state has one). In the event that the offended NRI finds it impossible to speak with such an officer, he may file a complaint with any non-governmental organization, such as the NRI Welfare Society of India, which will then forward the complaint to the government.


Legal Provisions:


The locus standi of proceedings brought by foreign individuals and foreign governments in India is governed by Sections 83 and 84 of the Indian Code of Civil Procedure.

  • Section 83 provides that alien enemies and alien friends who are residents of India with the Central Government's permission may file a lawsuit in any court that is otherwise qualified to hear the case as if they were Indian citizens, but alien enemies who are residents of India without the Central Government's permission may file a lawsuit in any court that is otherwise qualified to hear the case Section 84 stipulates that In any capable court, a foreign state may file a lawsuit: Provided that the goal of the suit is to carry out a private privilege granted to the ruler of that state or any officer acting in that state's official capacity.

  • A foreigner's lawsuit against an Indian will be heard by an experienced Indian court.

  • A foreign company may file a lawsuit against an Indian company in an Indian court.

  • An enemy from another planet may defend a suit.

  • A foreign state may sue an Indian for a private wrong in India..
